No big changes in H-1B Visa coming

Did you hear the H-1B News from June of 2018, the US Deputy chief of mission MaryKay Carlson said that there ”have been no big changes in the H1 program and nothing new on H-4.”  H-4 is of course the spouses. This is according to the Financial Express – But what does it mean?

The Deputy chief was in New Delhi India to observe “Student Visa Day” an event to celebrate higher education ties between India and the United states.  

On the other hand, Ms. Carlson also said that President Trump was reviewing the H-4 visa program and reports of possible revocation…but nothing yet.

So what does this posturing mean.  Here’s four interpretations of this news from my legal and political thinking cap.

  1. What if Trump really doesn’t care and just wants to throw red meat at his base?

Well, think about it.  Maybe Trump has to say something, but knows that the H-1B thing is not really a big deal at all.  Why not? There estimates that I see for numbers of the H-1B indians in the US ranges from 400k to 600k of these visa holders.  These are lawful, well educated, and employed people. Meanwhile…there are about 12-13 million people in the United states without status.  Unlike H-1Bs, which are over 95% bachelors, and over 50% masters or doctorates, your average person that lacks legal status in the United States has no such education – nor lawful employment.  The lack of status means they cannot be lawfully employed in the US, or even lawfully residing in the US. So President Trump probably doesn’t care about shaking up the H-1B system and may just be politically posturing because his political capital is not unlimited.

 

2) President Trump could be better use that political capital  We have identified a more pressing problem. What do you call people in the united states that are not lawfully there.  Some call them illegal immigrants. Some say they are undocumented…the technical term is that they have no legal status.  They are not h-1b, or h-4…or anything. So, we call them people without status to not judge them as much as the term illegal immigrant does.

 

The millions of people without status in the US are a far larger and more political advantageous target for the trump administration.  Remember his build the wall platform? How’s that going. Yeah no where…so that leads us to the next logical aspect of interpreting what Ms. Carlson’s comments on no changes mean.

 

3) What can you interpret from the build a wall stuff going absolutely nowhere – and fast.   Maybe that – It’s just pandering for votes. Do you really think he is going to get that wall built?  Or was that just something to shout at his rally. Does anyone honestly believe the wall will start construction in any real way before the Midterms?  No flipping way!! Why not!? Because it will take an – Act of Congress

 

4) Act of Congress.  What’s that mean? It means that H-1Bs are a law from back in 1990 and that has not be substantially tweaked or changed since 2004 because it takes an Act of Congress.  Congress is way less likely to act in 2018 because they have an election in November. If they do something to upset a vocal, highly educated, and affluent group that votes – Say Indian Americans that began their path to citizenship on an H-1B, then they are not going to do it….but that being said.  Those politicians will ask for money. – It’s just how the game is played.

You’re probably Indian if you are watching this…because in 2016 Indians were 74.2 percent of all H1bs, but rose to 75.6% in 2017  (while china is number 2 way back at only 9.3 to 9.4%) (cut to the EB5 visa option may explain why so much fewer Chinese use the h-1b, but for more of the EB5 visa, watch for our update on that).
  2. Initial H-1B petions dropped again in 2017 – down from 70,737 in 2016 to only 67,815 in 2017 – perhaps illustrating the Trump effect
  3. In all there were 276,423 Indians on H-1b visas in 201.
  4. It a myth that H-1Bs depress wages becuase of the minimum of 60k that is required by law because the average h1b earns 85,000 in 2017.
  5. H-1bs are far more likely to have a master’s degree than the average american – 44.5% of the approfed pettiions were for people with at a masters degree – 6.6 percent had a doctorate.
  6. Bonus – h-1bs continue to become the tech visa as computer releated occupations rose another 6.6% from 2016 to 2017 up to 254,592 woks with computer related H1Bs
